On 4/24/2010 at approximately 12:30am, Sgt. Ken Weems and Sgt. Larry Chambers, of the Galveston Police Department, were on patrol in the West Isle Communities.  As they were traveling in the 8000 block of FM 3005, they observed the driver of a maroon Chevrolet truck weaving in and out of the traffic lane.  Sgt. Weems activated the patrol cars video system to record the behavior as they followed the vehicle.
The driver was observed to commit more similar infractions and a traffic stop was conducted to investigate.

    As Sgt. Weems approached the vehicle, he immediately smelled a strong odor of cologne emanating from the vehicle.  In addition to the smell of cologne, Sgt. Weems smelled a strong odor of marijuana as well.  Sgt. Weems asked the occupants if they had any marijuana and the driver admitted being in possession.

    Sgt. Chambers retrieved a blue gym bag from the truck which was found to contain a plastic bag full of marijuana.  The marijuana was found to weigh over 14 ounces, a felony amount.

    The driver of the vehicle, identified as Suspect- Dustyn Hertenberger (m/w, 10/17/1990) of Santa Fe, was charged with Felony Possession of Marijuana with bond set at $5,000.00.  The other occupants in the vehicle, including two juveniles (age 16), were released without charges.
